Article 1 - Scope of application

The following general terms and conditions of sale govern the relationship between :

The company TRESSAGES DU DORLAY on the one hand, and on the other hand, any legal entity or individual wishing to use the following TRESSAGES DU DORLAY services: remote purchases via the Internet site https://www.gaine-tressee.com/, purchases via traditional channels.

These general terms and conditions of sale govern the commercial relationship between TRESSAGES DU DORLAY and its customers, whether legal entities or individuals.

They can be consulted online on the TRESSAGES DU DORLAY website, and will be applied to any order placed by the customer.

TRESSAGES DU DORLAY reserves the right to adapt or modify these terms and conditions of sale at any time. This is why, before validating an order, the customer must consult and validate the general sales conditions.

Article 2 - Characteristics of the goods and services offered

  • On the basis of a customer's drawing and precise characteristics, in particular the cross-sections and dimensions of the products specified by the customer, Tressages du Dorlay will offer its customers a product that meets their expectations within realistic tolerances.
  • Standardized product references offered in our catalog, whose description is also available online, within realistic tolerances.

Article 3 - Price

  • The prices indicated at the time of an order are given in euros excluding VAT.
  • All orders are payable in euros, regardless of the country in which the order is placed.

Product prices do not include delivery charges. Delivery charges will be indicated on the order form before the order is validated.

  • In the case of deliveries outside France, the provisions of the French General Tax Code relating to VAT must be applied.
  • Products will be invoiced on the basis of the rates in force at the time of order validation and acceptance of the quotation by the Customer.

TRESSAGES DU DORLAY reserves the right to modify its prices at any time.

Article 4 - Ordering

The customer wishing to place an order with TRESSAGES DU DORLAY undertakes to :

  • Provide precise contact details. Orders will be delivered to the address indicated in the contact form or to a relay point, depending on the delivery method chosen.
  • Confirm your order online after checking it and the delivery and billing addresses.
  • Make payment as agreed.
  • For all orders placed online for standardized products, packaging and availability conditions may be subject to change depending on the customer's overall order and the technical constraints linked to its production.
  • In the case of deferred payments negotiated by both parties, Les TRESSAGES DU DORLAY reserves the right to retain ownership of the products delivered until they have been paid for in full.

Confirmation of an order implies acceptance of these general terms and conditions of sale. The customer acknowledges having read and understood these terms and conditions, and hereby waives the right to invoke his or her own terms and conditions of purchase or any other terms and conditions.

Article 5 - Order validation

In order to validate the order, the customer must :

  • Fill in a contact form
  • Validate and accept the terms and conditions
  • Confirm your order and, if necessary, pay.
  • Orders will be validated upon receipt of payment unless otherwise agreed between the parties and validated by TRESSAGES DU DORLAY.

The customer must validate his order according to the criteria of choice of materials, finishes, sizes and colors.

  • Any order will be considered valid only after validation of a quotation and/or validation via the website on the button: "Validate my order". The validation of an order implies the validation of the general sales conditions by the customer.
  • TRESSAGES DU DORLAY undertakes to send an e-mail confirming the order received. If a validation e-mail is not received by the customer when placing an order via the website, the order cannot be considered valid.

TRESSAGES DU DORLAY reserves the right not to honour an order in the event that it cannot be fulfilled. TRESSAGES DU DORLAY then undertakes to reimburse the customer by any means of payment, within a period not exceeding 14 working days.

Article 6 - Availability of products and services

TRESSAGES DU DORLAY reserves the right to suspend the manufacture and delivery of its products in the event of a shortage of raw materials or a breakdown in the equipment used for manufacture. This suspension may occur at any time and for a period determined by TRESSAGES DU DORLAY.

Article 7 - Delivery of items

  • TRESSAGES DU DORLAY undertakes to make delivery within the time limit specified in the order form or confirmation e-mail.
  • The OBJECTS will be delivered to the address indicated in the contact form or the relay point agreed between TRESSAGES DU DORLAY and the customer.

TRESSAGES DU DORLAY undertakes to respect the usual production and delivery times and to inform the customer of any delays. In the event of a delivery problem, beyond the proposed deadline, TRESSAGES DU DORLAY undertakes to keep its customer regularly informed and to do its utmost to honour the delivery in the best possible conditions.

  • In the event of disagreement with the proposed lead time following a delivery problem and beyond the lead time announced when the order was placed, the customer may cancel the order. In this case, TRESSAGES DU DORLAY will reimburse the customer in full within 30 days in accordance with article L. 121-20-3 of the French Consumer Code.
  • If an anomaly is noted by the customer at the time of delivery, it must be detailed and signed by the customer in the space provided for this purpose on the delivery note, no later than 2 working days after delivery.
  • TRESSAGES DU DORLAY cannot be held responsible for delivery problems due to a delay by the carrier, in the event of loss of the parcel by the carrier or in the event of a strike by the delivery services.

Article 8 - Right of withdrawal

In accordance with the provisions of article L 121-20 of the French Consumer Code, the right of withdrawal is excluded where TRESSAGES DU DORLAY manufactures OBJECTS in accordance with the customer's specifications or which are clearly personalized.

Article 9 - Warranty and liability

  • TRESSAGES DU DORLAY guarantees that its products are made in France from materials complying with current standards. Given the special nature of our products, tolerances of + or - 5 mm in our measurements are considered normal.
  • TRESSAGES DU DORLAY cannot be held responsible for allergic reactions to the materials used to manufacture the braids or for any other consequences inherent to the customer.

The customer undertakes to use the products delivered within the scope of their intended use.

TRESSAGES DU DORLAY cannot be held responsible for the use of its products in an unsuitable environment.

Article 10 - Intellectual property

  • The customer undertakes not to have infringed any third party intellectual property rights by transmitting this file to TRESSAGES DU DORLAY. The customer only grants TRESSAGES DU DORLAY a license to use the file for the purpose of fulfilling the order.
  • The customer undertakes not to use the data, characteristics and plans supplied by TRESSAGES DU DORLAY for the purposes of reproduction.
  • The products offered by TRESSAGES DU DORLAY remain the intellectual property of TRESSAGES DU DORLAY. Any reproduction is prohibited and will be prosecuted.
  • TRESSAGES DU DORLAY undertakes not to use customer plans for purposes other than those decided by the customer.

Article 11 - Personal data

  • In accordance with the French Data Protection Act of January 6, 1978, personal data relating to customers may be processed automatically.
  • The processing of data by TRESSAGES DU DORLAY may also be used by and transmitted to companies that TRESSAGES DU DORLAY may call upon for the management, execution and delivery of orders as well as the processing and payment thereof.
  • Data concerning the customer may be kept by TRESSAGES DU DORLAY for legal purposes.

However, the customer has the right to access and rectify this data in accordance with the law of January 6, 1978.

TRESSAGES DU DORLAY reserves the right to transmit the information collected for commercial purposes. Customers may object to the disclosure of their personal details by notifying TRESSAGES DU DORLAY.

The automated processing of information, including the management of site users' e-mail addresses, was the subject of a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL) on January 5, 2010, registered under number 15436207.

Article 12 - Settlement of disputes

  • All clauses in these general terms and conditions of sale, as well as all sales and purchase transactions, shall be governed by French law.
  • In the event of a dispute, both parties agree to make every effort to find an amicable solution.
  • In the event of disagreement between the parties, the courts of the Saint Etienne Court of Appeal shall have exclusive jurisdiction.
